1. MyOpinions Prize Draw Official Rules
These official rules (the "Rules") apply to prize draws conducted by the "Promoter", MyOpinions Pty Ltd. The Competition "$5,000 Cash Competition" will be promoted on the MyOpinions website, http://www.myopinions.co.nz (the "Site") from Friday, 18th March 2011, the day the promotion commences.
2. Rules
Information on the prizes and how to enter form part of these Rules. Participation in this promotion is deemed acceptance of these Rules.
3. Eligibility
3.1 The Prize draw is only open to registered members of MyOpinions who remain active members during the promotional period and who comply with all the MyOpinions Terms and Conditions of membership.
3.2 Each occasion that a member participates in an online market research survey that is eligible to earn MyOpinions points, the member will receive between one and one hundred entries. The number of entries given for each survey will be stated clearly on the survey invitation email.
3.3 MyOpinions may offer additional entries into the competition to members who complete the profile questionnaire. The total number of entries given for completing the questionnaire and the conditions and requirement for earning those entries will be clearly specified on the webpage or any other promotional materials sent to members.
3.4 MyOpinions may offer additional entries into the competition to its members who verify their postal address, email address and phone number. The total number of entries given for verifying and the conditions and requirement for earning those entries will be clearly specified on the webpage or any other promotional materials sent to members.
3.5 For promotional purposes MyOpinions may make an offer of additional entries into the competition to members that complete certain actions, such as filling in a questionnaire or using a MyOpinions web site feature. When an offer of additional entries is made, the number of entries a member can earn and the conditions and requirements for earning those entries will be clearly indicated on the promotional material.
3.6 Employees and immediate families of The Promoter and its agencies associated with this promotion are not eligible to win this competition.
3.7 MyOpinions reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that does not comply with all these Conditions of Entry.
4. Promotional Period
4.1 The promotion commences at 16:00 on Friday, 18th March 2011.
4.2 The promotion closes at 15:59 on Wednsday, 21st March 2012.
5. Number of Draws: 10 in total.
6. Method for Drawing the Winners: Random Barrel Draw.
7. Prize Pool Value: NZ$5,000.00 (10 X NZ$500 cheques).
8. Winner's Cheque: A cheque for $500 will be made out in the name of the first 10 randomly drawn winners. The cheque will be posted to each winner's address as indicated in their MyOpinions membership account as at the time of the draw.
9. Draw Dates and Times
The draw to determine the winners will take place at 14:00 on Thursday, 22nd March 2012.
10. Validity of Entries
10.1 Valid entries for the prize draw will be those entries received between 16:00 on Friday, 18th March 2011 and 15:59 on Wednsday, 21st March 2012.
10.2 The Promoter's decision is final and no correspondence will be entered into.
10.3 The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
11. Winner Notification and Prize Redemption
11.1 The winners will be notified by email on Friday, 23rd March 2012 via the email address that is currently registered in their MyOpinions account.
11.2 The winner's details will be published on the MyOpinions website on Friday, 30th March 2012.
11.3 All delivery/postage costs associated with the prize are the responsibility of The Promoter.
11.4 The winners must redeem their prize by cashing the cheque within 3 months of the relevant draw date otherwise the prize will be forfeited.
12. Promoter Indemnification
12.1 Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under The Promoter's control); (b) any theft, unauthorised access or third party interference.
12.2 All entries become the property of The Promoter. Entrants consent to The Promoter using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by The Promoter.
12.3 The Promoter shall not be liable for any tax implications that may arise as a result of the prize. Independent financial advice should be sought.
12.4 The Promoter is not responsible for any incorrect or inaccurate information, whether caused by the Site's users or by any of the equipment or programming associated with or utilised in this competition, or by any technical or human error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, computer viruses, bugs, unauthorised intervention, fraud, technical failures, theft or destruction or unauthorised access to or alteration of entries. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
12.5 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
