Prize Competition Terms & Conditions
1. SmileCity Prize Draw Official Rules
These official rules (the "Rules") apply to prize draws conducted by the "Promoter", SmileCity Limited (GST# 84 602 701) of PO Box 10061, Dominion Road, Mt Eden, Auckland, New Zealand. The Competition "$5,000 Prize Competition" will be promoted on the SmileCity website, http://www.smilecity.co.nz (the "Site") from Wednesday, 21 January 2015, the day the promotion commences.
2. Rules
Information on the prizes and how to enter form part of these Rules. Participation in this promotion is deemed acceptance of these Rules.
3. Eligibility
3.1 The Prize draw is open only to registered members of SmileCity who remain active members during the promotional period and who comply with all the SmileCity Terms and Conditions of membership.
3.2 Each occasion that a member clicks on the correct link in a permission email message ("Email Offers") sent by SmileCity, the member will automatically be issued with two entries into the competition.
3.3 Each occasion that a member participates in an online market research survey that is eligible to earn SmileCity points, the member will receive between one and one hundred entries. The number of entries given for each survey will be stated clearly on the survey invitation email.
3.4 For promotional purposes SmileCity may make an offer of additional entries into the competition to members that complete certain actions, such as visiting a web site, clicking a link, filling in a profile questionnaire or using a SmileCity web site feature. When an offer of additional entries is made, the number of entries a member can earn and the conditions and requirements for earning those entries will be clearly indicated on the promotional material.
3.5 Employees and immediate families of The Promoter and its agencies associated with this promotion are not eligible to win this competition.
3.6 SmileCity reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that does not comply with all these Conditions of Entry.
4. Promotional Period
4.1 The promotion commences at 16:00 on Wednesday, 21 January 2015.
4.2 The promotion closes at 15:59 Wednesday, 03 February 2016.
5. Number of Draws: 50 in total.
6. Method for Drawing the Winners: Random Barrel Draw.
7. Prize Pool Value: NZD$5,000.00 (50 X NZ$100 eGifts).
8. Winners' Prize: A GiftPay electronic gift voucher (eGift) for NZ$100 will be emailed to the first 50 randomly drawn winners. The eGift will be emailed to each winner's email address as indicated in their SmileCity membership account as at the time of the draw. Each eGift is redeemable for a selection of eGift cards and vouchers issued by various New Zealand retailers up to the face value of the eGift. Each eGift card or voucher brand and denomination is subject to demand and availability. The GiftPay eGift platform is owned and operated by GiftPay Pty Ltd (www.giftpay.com). Prizes are not transferrable, and are not redeemable for cash.
9. Draw Dates and Times
The draw to determine the winners will take place at 14:00 on Thursday, 04 February 2016.
10. Draw Venue
The venue for the draw will be the offices of The Promoter.
11. Validity of Entries
11.1 Valid entries for the prize draw will be those entries received between 16:00 on Wednesday, 21 January 2015 and 15:59 on Wednesday, 03 February 2016.
11.2 The Promoter's decision is final and no correspondence will be entered into.
11.3 The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
12. Winner Notification and Prize Redemption
12.1 The winners will be notified by email on Friday, 05 February 2016 via the email address that is currently registered in their SmileCity account.
12.2 The winners' details will be published on the SmileCity website on Friday, 12 February 2016.
12.3 All delivery/postage costs associated with the prize are the responsibility of The Promoter.
12.4 If the prize delivery email is returned or bounces back marked "undeliverable" then the prize is considered to be unclaimed.
12.5 The winners must redeem their eGift prize via available retailers within 3 months of the relevant draw date otherwise the prize will be forfeited.
13. Promoter Indemnification
13.1 Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under The Promoter's control); (b) any theft, unauthorised access or third party interference.
13.2 All entries become the property of The Promoter. Entrants consent to The Promoter using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by The Promoter.
13.3 The Promoter shall not be liable for any tax implications that may arise as a result of the prize. Independent financial advice should be sought.
13.4 The Promoter is not responsible for any incorrect or inaccurate information, whether caused by the Site's users or by any of the equipment or programming associated with or utilised in this competition, or by any technical or human error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, computer viruses, bugs, unauthorised intervention, fraud, technical failures, theft or destruction or unauthorised access to or alteration of entries. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
13.5 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
